Privacy Policy

This U.S. Online Privacy Notice (Notice) applies to this online interface (i.e., website or mobile application) and any TLE U.S. affiliate or subsidiary online interface that links to this Notice, (each, a Site, and, collectively, Sites).  The term “TLE” or “we” or “us” or “our” in this Notice refers to TLE Enterprises and any affiliates or subsidiaries of TLE Corporation that link to this Notice. This Notice describes how Sites may collect, use and share information from or about you, and explains how information may be collected and used for advertising purposes.

TLE provides other online interfaces not covered by this Notice.  If you visit or access your accounts from one of these sites, please review the online privacy practices of that site to understand how your online information may be collected, used and shared.

For U.S. account holders and visitors to this Site, we will use and share any information that we collect from or about you in accordance with the Community Guidelines and User Agreement and all applicable laws and regulations.

TLE Foundation is a 501(c) non-profit organization (Form 990). Although the additional information is provided as a resource, the terms and conditions of this Notice control, and by using the Site, you agree to the terms and conditions of this Notice.

Collecting and Using Information

Personal Information We Collect Online

Personal Information means personally identifiable information such as information you provide via forms, surveys, applications or other online fields including name, postal or email addresses, telephone, fax or mobile numbers, or account numbers.

How We Use Personal Information

We may use Personal Information:

  • to respond to your inquiries and fulfill your requests;
  • to inform you about important information regarding the Site, products or services for which you apply or may be interested in applying for, or in which you are already enrolled, changes to terms, conditions, and policies and/or other administrative information;
  • to deliver marketing communications that we believe may be of interest to you, including, ads or offers tailored to you;
  • to personalize your experience on the Site;
  • to allow you to apply for products or services and evaluate your eligibility for such products or services;
  • to verify your identity and/or location (or the identity or location of your representative or agent) in order to allow access to your accounts, conduct online transactions and to maintain measures aimed at preventing fraud and protecting the security of account and Personal Information;
  • to allow you to participate in surveys and other forms of market research, sweepstakes, contests and similar promotions and to administer these activities. Some of these activities have additional rules, which may contain additional information about how Personal Information is used and shared;
  • to allow you to use some Site planning tools. Information that you enter into one of these planning tools may be stored for future access and use. You have the option not to save the information;
  • understand what product or service may be of interest to you; and present you with offers;
  • collected through our social media pages and other online interactions with you to assist in verifying your identity and account status.  We may combine this online information with information collected from offline sources or information we already have;
  • for business purposes, including data analysis, audits, developing and improving products and services, enhancing the Site, identifying usage trends and determining the effectiveness of promotional campaigns;
  • for risk control, for fraud detection and prevention, to comply with laws and regulations, and to comply with other legal process and law enforcement requirements;
  • to allow you to utilize features within our Sites by granting us access to information from your device such as contact lists, or geo-location when you request certain services.
How Personal Information is Shared

Please see the Community Guidelines and User Agreement for information on how Personal Information may be shared and how you may be able to limit certain types of sharing.

Other Information We Collect Online

Other Information is any information other than Personal Information that does not reveal your specific identity or does not directly relate to an individual, such as browser information, information collected through cookies, pixel tags and other technologies, demographic information, other information provided by you such as your date of birth or household income, and aggregated and de-identified data.

How We Collect and Use Other Information

We and our third-party service providers may collect and use Other Information in a variety of ways, including:

  • Through your browser or device: Certain information is collected by most browsers and/or through your device, such as your Media Access Control (MAC) address, device type, screen resolution, operating system version and internet browser type and version. We use this information to ensure Sites function properly, for fraud detection and prevention, and security purposes.
  • Using cookies: Cookies are pieces of information stored directly on the device you are using. Cookies we use do not contain or capture unencrypted Personal Information. Cookies allow us to collect information such as browser type, time spent on the Site, pages visited, language preferences, and your relationship with us. We use the information for security purposes, to facilitate navigation, to display information more effectively, to personalize/tailor your experience while engaging with us, and to recognize your device to allow your use of our online products and services. We collect statistical information about the usage of the Site in order to continually improve the design and functionality, to monitor responses to our advertisements and content, to understand how account holders and visitors use the Site and to assist us with resolving questions regarding the Site. We also utilize cookies for advertising purposes. Please see the Advertising section below for more information.

You can refuse to accept these cookies and most devices and browsers offer their own privacy settings for cookies.  You will need to manage your cookie settings for each device and browser you use. However, if you do not accept these cookies, you may experience some inconvenience in your use of the Site and some online products and services.  For example, we will not be able to recognize your device and you will need to answer a challenge question each time you log on.  You also may not receive tailored advertising or other offers from us that may be relevant to your interests and needs.

  • Other technologies including pixel tags, web beacons, and clear GIFs: These may be used in connection with some Site pages, downloadable mobile applications and HTML-formatted email messages to measure the effectiveness of our communications, the success of our marketing campaigns, to compile statistics about usage and response rates, to personalize/tailor your experience while engaging with us online and offline, for fraud detection and prevention, for security purposes, for advertising, and to assist us in resolving account holders’ questions regarding use of our Site. Please see our Advertising section below for more information regarding our use of other technologies.
  • Flash objects: As part of our solutions for online authentication, we use Flash objects (sometimes referred to as “Local Shared Objects”) to help us recognize you and your device when you come back to the Site. For our pages running Adobe® Flash® content (demos and tutorials with moving content), we use Flash objects to determine your browser type and version of Adobe Flash in order for you to view the content. We do not use Flash objects for any online behavioral advertising purpose. Deleting cookies does not delete Flash objects. You can learn more about Flash objects – including how to control and disable them – through Adobe. If you choose to disable Flash objects from our Site, then you may not be able to access and use all or part of the Site or benefit from the information and services offered.
  • IP Address: Your IP Address is a number that is automatically assigned to the device that you are using by your Internet Service Provider (ISP). An IP Address is identified and logged automatically in our server log files whenever a user visits the Site, along with the time of the visit and the page(s) that were visited. Collecting IP Addresses is standard practice on the internet and is done automatically by many websites. We use IP Addresses for purposes such as calculating Site usage levels, helping diagnose server problems, to personalize/tailor your experience while engaging with us online and offline, for compliance and security purposes, for advertising, and administering the Site. Please see the Advertising section below for more information.
  • Aggregated and De-identified Data: Aggregated and De-identified Data is data that we may create or compile from various sources, including but not limited to accounts and transactions.  This information, which does not identify individual account holders, may be used for our business purposes, which may include offering products or services, research, marketing or analyzing market trends, and other purposes consistent with applicable laws.

Additional Information

Third party widgets – we may allow certain widgets (e.g., social share buttons) on our Sites that enable users to easily share information on another platform, such as a social media platform.  The third parties that own these widgets may have access to information about your browsing on pages of our Sites where these widgets are placed.  You may wish to review information at the third party site, such as social media platforms where you have an account, to determine how these third parties collect and treat such information.  Also, see Linking to other sites and Social media sites below.

Advertising

TLE advertises online (e.g., pages within our Sites and mobile apps through managed social media presences, and on other sites and mobile apps not affiliated with TLE) and offline (e.g., through call centers, and direct marketing). In order to understand how advertising performs, we may collect certain information on our Sites and other sites and mobile apps through our advertising service providers using cookies, IP addresses, and other technologies. The collected information may include the number of page visits, pages viewed on our Sites, search engine referrals, browsing activities over time and across other sites following your visit to one of our Sites or apps, and responses to advertisements and promotions on the Sites and on sites and apps where we advertise.

TLE uses information described in this Notice to help advertise our products and services, including prescreened offers of credit, in a variety of ways. We use such information to:

  • Present tailored ads, to you including:
    • Banner ads and splash ads that appear as you sign on or off of your online accounts on our Sites, within mobile and other mobility applications
    • E-mail, postal mail, and telemarketing, and,
    • On other sites and mobile apps not affiliated with TLE;
  • Analyze the effectiveness of our ads; and
  • Determine whether you might be interested in new products or services

How we tailor ads:

Relationship based advertising

In order to help make our advertising informative and useful, we may use information about your relationship with us (such as types of accounts, transactional information or the state in which you act) to help determine which advertisements or offers to present to you.

Online Behavioral Advertising

We or our advertising service providers may use certain information about your activities on our Sites, such as pages visited and search keywords entered to help determine which of our advertisements or offers may be of interest to you. We limit access and collection of information for specific purposes by advertising service providers. We may use this online information for online and offline advertising.

Advertising on third party sites and mobile apps

TLE contracts with advertising companies to advertise our products and services on sites and mobile apps not affiliated with us.  We may use Aggregated and De-identified Data and information provided by you to these third party sites and mobile apps to select which of our advertisements or offers may appeal to you, display them to you and monitor your responses.  Third Party sites and mobile apps are not subject to TLE Privacy Notices. Please visit the individual sites and mobile apps for additional information on their data and privacy practices and opt out policies.

Online Behavioral Advertising on third party sites and mobile apps

Some of our tailored ads are online behavioral advertising, and may be served using data collected by third party providers. Ads served on our behalf by these companies do not contain unencrypted Personal Information and we limit the use of information by companies that serve our ads. To learn more about this practice and your choices in connection with it, see the section Advertising Choices below

Advertising Choices

You may set your choices for advertising in the following ways:

Online Behavioral Advertising: If you prefer we not use information based on online Site behavior to provide online and offline tailored content and advertising, you may opt out of online behavioral advertising.

Opting out also means that the online content and advertising you receive on our non-servicing sites (i.e. before sign-in) will be untailored and will not be based on your online behavior or your relationship.

Please note that if you opt out of this advertising, you may still receive untailored advertising from TLE.  When accessing online account servicing areas (i.e. after sign-in), you may receive tailored content and advertising based on your account relationships.  In addition, we may continue to use information collected online as described in this Notice to provide details on products and services in accordance with account agreements. 

Direct Marketing:  If you prefer we not deliver you marketing offers in email, postal mail or through telemarketing you may manage your direct marketing preferences through a representative via the Online Community.

Advertising on third party sites: TLE participates in the Digital Advertising Alliance (DAA) self-regulatory program, uses the  Advertising Options Icon on our behavioral ads on third party sites (excluding ads appearing on platforms that do not accept the icon) and adheres to the DAA self-regulatory Principles for Online Behavioral Advertising. Anyone receiving a behavioral ad may click on the displayed icon to receive more information and can opt out at that time or by visiting the third party site’s privacy policy for an opt out mechanism.

You may also opt out of receiving behavioral ads from many sites through the Network Advertising Initiative’s Opt-Out Tool or other tools provided by the publishing platform.

Please note that if you opt out, you may still receive untailored online advertising from TLE. Opting out from a specific third party site means that the ads you receive will not be tailored based on your choices or behavior.

Important Reminder

In order for online behavioral advertising opt outs from our Sites and on other sites to work on your device, your browser must be set to accept cookies. If you delete cookies, buy a new device, access our Site or other sites from a different device, login under a different screen name, or change web browsers, you will need to opt-out again. If your browser has scripting disabled, you do not need to opt out, as online behavioral advertising technology does not work when scripting is disabled. Please check your browser’s security settings to validate whether scripting is active or disabled.

Mobile Applications

TLE’s Mobile Applications for U.S. accounts (“Applications”) allows you to access your account balances and holdings, make deposits, transfers and pay bills on your mobile device.  This Notice applies to any Personal Information or Other Information that we may collect through the Applications.

Linking to other sites

We may provide links to third party sites, such as credit bureaus, service providers or merchants. If you follow links to sites not affiliated or controlled by TLE, you should review their privacy and security policies and other terms and conditions, as they may be different from those of our Sites. TLE does not guarantee and is not responsible for the privacy or security of these sites, including the accuracy, completeness, or reliability of their information.

Social media sites

TLE provides experiences on social media platforms including, but not limited to, Facebook®, Twitter®, YouTube® and LinkedIn® that enable online sharing and collaboration among users who have registered to use them. Any content you post on official TLE managed social media pages, such as pictures, information, opinions, or any Personal Information that you make available to other participants on these social platforms, is subject to the Terms of Use and Privacy Policies of those respective platforms. Please refer to them to better understand your rights and obligations with regard to such content.  In addition, please note that when visiting any official TLE social media pages, you are also subject to TLE’s Community Guidelines and User Agreement.

Security

To protect Personal Information from unauthorized access and use, we use security measures that comply with applicable federal and state laws.  These measures may include device safeguards and secured files and buildings as well as oversight of our third party service providers to ensure information remains confidential and secure. 

Using other aggregation websites

Other companies offer aggregation websites and services that allow you to consolidate your account information from different sources (such as your accounts with us or with other institutions) so that you can view all your account information at one online location. To do this, an aggregation provider may request access to Personal Information, such as financial information, usernames and passwords. You should use caution and ensure that the aggregator company has appropriate policies and practices to protect the privacy and security of any information you provide or to which they are gaining access. We are not responsible for the use or disclosure of any Personal Information accessed by any company or person to whom you provide your Site username and password.

If you provide your Site username, password or other information about your accounts with us to an aggregation website, we will consider that you have authorized all transactions or actions initiated by an aggregation website using access information you provide, whether or not you were aware of a specific transaction or action.  If you decide to revoke the authority you have given to an aggregation website, we strongly recommend that you change your password for the Site to ensure that the aggregation website cannot continue to access your account.

Making sure information is accurate

Keeping your account information accurate and up to date is very important. If your account information is incomplete, inaccurate or not current, please use the Contact Us option on our Site, or call or write to us at the telephone numbers or appropriate address for changes listed on your account statements, records, online or other account materials.

Protecting children’s privacy online

The Site is not directed to individuals under the age of thirteen (13), and we request that these individuals do not provide Personal Information through the Site. We do not knowingly collect information from children under 13 without parental consent.  Visit the Federal Trade Commission website for more information about the Children’s Online Privacy Protection Act (COPPA).

Protecting individual health information

To the extent that we receive, maintain, or process an individual’s protected health information, TLE may disclose that information as authorized by and in accordance with applicable federal and/or state law.

Updates to this Privacy Notice

This U.S. Online Privacy Notice is subject to change. Please review it periodically. If we make changes to the U.S. Online Privacy Notice, we will revise the “Last Updated” date at the top of this Notice. Any changes to this Notice will become effective when we post the revised Notice on the Site. Your use of the Site following these changes means that you accept the revised Notice.



User Agreement

Thank you for taking the time to review this Learning Community User Agreement. TLE (“We,” “Us,” or “Our”) is pleased to provide the The Lonely Entrepreneur Learning Community (“Community”) subject to these terms, at the following Internet site – https://tlefoundation.org

This Agreement is a legal contract between you and TLE. By registering for or using the Community or any of its related services, you agree that you have read and understand these terms and Our Rules of the Road and you agree to be bound by them. If you do not agree to these terms, do not use or otherwise access the Community.

We reserve the right, in our sole discretion, to modify this Agreement at any time. Modified terms are effective as soon as they are posted. We also reserve the right to waive or modify any of these terms as they apply to a specific posting or member without affecting the application of these terms to all other postings and members. Your continued use of the Community, or any materials or services accessible through it, after modified terms are posted means you accept the modifications.

To the extent there is a conflict between TLE’s Online Privacy Practices Policy and this Agreement, this Agreement’s terms will govern.

Registration

To register as a Community user, you will need to create a screen name to identify yourself to others. You must be legally competent to enter into contracts. You may not have a screen name that is vulgar, attempts to impersonate another person or violates the rights of others, including the intellectual property rights of any person or entity. We also may reject any screen name that we determine at our discretion is unacceptable for use in the Community.

The information you provide during registration must be accurate and complete, and you agree not to register under the name of another person or otherwise impersonate any other person, including any Community user, moderator, public figure, or TLE employee. If, after investigation, TLE has reasonable grounds to suspect that your information is untrue, inaccurate, not current, or incomplete, we may suspend or terminate your account and prohibit future use of the Community.

We explicitly disclaim liability for any and all losses and damages arising from your failure to comply with this section.

Personal Responsibility

You are solely responsible for your use of the Community. You are responsible for all activities under your screen name, including the use of your screen name by others. You are responsible for keeping your password confidential. You may use the Community for lawful purposes only.

We take no responsibility and have no liability for any content you or any other user may post. User-posted content does not represent the advice, views, opinions, or beliefs of TLE, and we make no claim of accuracy of any user-posted material.

The Community may contain or reference links to non-TLE websites (“third party websites”). By accessing the Community or following links to third-party websites, you may be exposed to content that you consider offensive or inappropriate. TLE is not responsible for the content of any third-party website or any link contained in a third-party website. The inclusion of a link within the Community does not imply any endorsement by or any affiliation with Us. Access to any third-party website is at your own risk, and you should be aware that third-party websites may contain terms and privacy policies that are different from the Community. We are not responsible for such provisions and expressly disclaim any liability for them.

In connection with your use of the Community, you may be made aware of services, products, articles, offers, and promotions provided by third parties, and not by Us. If you decide to use these third-party services, you are responsible for reviewing and understanding the terms and conditions governing those services. You agree that the third party, and not TLE, is responsible for performance of the services.

You are bound by our Rules of the Road, please review them carefully and periodically. The Community relies upon its users to identify and report content or conduct that is in contravention of the Rules of the Road. Therefore, it is each member’s responsibility to report objectionable content by utilizing the “Report as inappropriate” functionality available throughout the Community.

Monitoring and Moderation

TLE has designated outside entities to act as Community Moderators. Community Moderators do not pre-screen postings or monitor on a “real time” basis. Community Moderators have the right, but not the obligation, to edit or remove content and postings at their discretion, either because there has been a violation of this Agreement or the Rules of the Road, or for any other purpose. Community Moderators are the only authorized representatives of TLE in the Community.

The Community Moderators may or may not investigate any complaint that is brought to their attention, and may or may not take appropriate action, including, but not limited to issuing warnings, removing the content, or suspending or terminating the username. Because situations and interpretations vary, it is possible that no action will be taken whatsoever. The failure to act with respect to a violation by you or others does not waive the ability to act differently with respect to subsequent or similar violations.

Warnings, Suspensions, and Terminations

Community Moderators may communicate with you personally concerning your participation in the Community or related matters. Those communications are not intended to be made public, and you agree not to post or otherwise disseminate those communications within the Community or elsewhere, on the Internet or otherwise.

You agree that your membership in and access to the Community may be immediately suspended or terminated without explanation or prior notice. Without limiting the foregoing, the following will lead to a termination of a user’s membership in and access to the Community: 1) breaches or violations of this Agreement, Our Rules of the Road, or other incorporated agreements or guidelines, 2) requests by law enforcement or other government agencies, 3) a request by you (self-initiated account deletions), 4) unexpected technical issues or problems, and 5) extended periods of inactivity. Termination of your Community membership includes removal of access to all offerings within the Community and may also bar you from further use of the Community. Furthermore, you agree that neither TLE nor the Community Moderators shall be liable to you or any third-party for any termination of your membership in or access to the Community.

Rights to Content

For any content that you submit, including, but not limited to, data, text, messages, files, documents, images, photographs, videos, audiovisual works, musical compositions, sound recordings, postings, your and/or other persons’ names, likenesses, voices, screen names, profiles, actions, appearances, performances and/or other biographical information or material, and any other materials, you grant TLE a perpetual, irrevocable, royalty-free, transferable right and license to use, copy, modify, delete in its entirety, adapt, publish, translate, create derivative works from and/or sell and/or distribute such content and/or incorporate such content into any form, medium or technology throughout the world, on an unrestricted basis for any purpose, without the requirement of any permission from or compensation to you.

None of the content that you submit shall be subject to any obligation of confidence on the part of TLE, its agents, subsidiaries, affiliates, partners, or third party service providers and their respective directors, officers, and employees. All content that you submit may be used at TLE’s sole discretion. We shall not be liable for any use or disclosure of any content. Without limiting the foregoing, you hereby grant Us, without the requirement of any permission from or payment to you or to any other person or entity, a perpetual, irrevocable, transferable, fully-paid, royalty-free, non-exclusive, and sub-licensable worldwide license to use, re-use, reproduce, print, transmit, publish, exhibit, display, distribute, re-distribute, copy, host, cache, archive, store, index, categorize, , stream, comment on, edit, alter, modify, adapt, translate, create derivative works based upon such content, in whole or in part all without further notice to you and with or without attribution.

Privacy and Security

Any content that you place on the Community is posted at your own risk and can be obtained and used by others. Do not reveal information that you do not want to make public, such as posts including your contact information or email address. TLE disclaims any responsibility or liability arising from your disclosure of such personal information, or any other information, in any profile or posting.

TLE reserves the right to instruct the Community Moderators to remove any postings in the Community containing phone numbers, street addresses, or otherwise personally identifying information as it cannot verify such information or confirm the desire of said information to be posted by the individual to which this information pertains.

By submitting your email address to register, you agree that TLE, its third party service providers, and the Community Moderators may use your email address to contact you about your profile or any content you post on the Community, and for other administrative purposes related to the Community.

Indemnification

You hereby agree to indemnify, defend, and hold TLE, the Community Moderators, and all respective officers, directors, owners, employees, agents, representatives and assigns (collectively, the “Indemnified Parties”) harmless from and against any and all losses, damages, liabilities and costs (including, without limitation, settlement costs and any legal or other fees and expenses for investigating or defending any actions or threatened actions) incurred by the Indemnified Parties in connection with any claim arising out of any breach by you of this Agreement or the Rules of the Road or claims arising from your content or conduct. You shall use your best efforts to cooperate with us in the defense of any claim. We reserve the right, at our own expense, to employ separate counsel and assume the exclusive defense and control of any matter otherwise subject to indemnification by you.

Disclaimer of Warranties

THE CONTENT ON THE COMMUNITY (INCLUDING, WITHOUT LIMITATION, POSTINGS, THIRD PARTY CONTENT, AND ANY TLE CONTENT) IS PROVIDED “AS IS” AND CARRIES NO WARRANTIES. TLE DOES NOT WARRANT OR GUARANTEE THE ACCURACY, RELIABILITY, COMPLETENESS, USEFULNESS, NON-INFRINGEMENT OF INTELLECTUAL PROPERTY RIGHTS, OR QUALITY OF ANY CONTENT ON THE COMMUNITY, REGARDLESS OF WHO ORIGINATES THAT CONTENT. TLE DOES NOT WARRANT THAT THE COMMUNITY IS SECURE, FREE FROM BUGS, VIRUSES, INTERRUPTION, ERRORS, OR OTHER LIMITATIONS. YOU EXPRESSLY UNDERSTAND AND AGREE THAT YOU BEAR ALL RISKS ASSOCIATED WITH USING OR RELYING ON THAT CONTENT. TLE IS NOT LIABLE OR RESPONSIBLE IN ANY WAY FOR ANY CONTENT POSTED ON OR LINKED FROM THE COMMUNITY, INCLUDING, BUT NOT LIMITED TO, ANY ERRORS OR OMISSIONS IN CONTENT, OR FOR ANY LOSSES OR DAMAGE OF ANY KIND INCURRED AS A RESULT OF THE USE OF OR RELIANCE ON ANY CONTENT.

Limitation of Liability

MOST OF THE CONTENT (INCLUDING, WITHOUT LIMITATION, THE POSTINGS AND THIRD PARTY CONTENT) POSTED TO THE COMMUNITY IS PROVIDED BY REGISTERED THIRD PARTIES NOT AFFILIATED WITH TLE. SUCH THIRD-PARTY CONTENT IS THE SOLE RESPONSIBILITY OF THE PERSON ORIGINATING THAT CONTENT. YOU AGREE THAT TLE DOES NOT CONTROL, AND IS NOT RESPONSIBLE IN ANY WAY FOR THIS THIRD-PARTY CONTENT. ADDITIONALLY, YOU AGREE THAT TLE IS NOT LIABLE FOR, AND YOU SHALL INDEMNIFY AND HOLD TLE, AND ITS SUBSIDIARIES, AFFILIATES, OFFICERS, AGENTS, MODERATORS, AND EMPLOYEES HARMLESS FROM ANY CLAIM, INCLUDING REASONABLE ATTORNEY’S FEES, MADE BY ANY THIRD PARTY RELATING TO OR ARISING OUT OF CONTENT YOU SUBMIT, POST, TRANSMIT, OR MAKE AVAILABLE THROUGH THE COMMUNITY, YOUR USE OF THE COMMUNITY, YOUR VIOLATION OF THIS AGREEMENT OR THE RULES OF THE ROAD OR YOUR VIOLATION OF ANY RIGHTS OF ANOTHER.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, TLE AND ITS REPRESENTATIVES ARE NOT LIABLE FOR ANY INDIRECT, SPECIAL, INCIDENTAL, OR CONSEQUENTIAL DAMAGES (INCLUDING DAMAGES RELATING TO LOSS OF BUSINESS, TELECOMMUNICATION FAILURES, LOSS, CORRUPTION, SECURITY, OR THEFT OF DATA, LOSS OF PROFITS OR INVESTMENT, ACCOUNTING POSITIONS TAKEN BY YOU, OR THE LIKE), WHETHER BASED ON BREACH OF CONTRACT, BREACH OF WARRANTY, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, PRODUCT LIABILITY OR OTHERWISE, EVEN IF TLE OR ITS REPRESENTATIVES HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES AND EVEN IF A REMEDY SET FORTH HEREIN IS FOUND TO HAVE FAILED OF ITS ESSENTIAL PURPOSE. THE LIMITATIONS OF DAMAGES SET FORTH ABOVE ARE FUNDAMENTAL ELEMENTS OF THE BASIS OF THE BARGAIN BETWEEN TLE AND YOU. THESE LIMITATIONS MAKE IT POSSIBLE FOR TLE TO PROVIDE THE COMMUNITY TO YOU.

Choice of Law and Location for Resolving Disputes

You agree that the law of the state of New Jersey governs this contract and any claim or dispute that you may have against us, without regard toNew Jersey’s conflict of laws rules. You further agree that any disputes or claims that you may have against us will be resolved by a court located in the state ofNew Jersey. Our services are directed at a U.S. audience. We can not warrant that the Community is appropriate for users outside the United States or that use of the Community is permitted under the laws of other jurisdictions.

PLEASE NOTE THAT BY AGREEING TO THIS AGREEMENT, YOU ARE: (1) WAIVING CLAIMS THAT YOU MIGHT OTHERWISE HAVE AGAINST US BASED ON THE LAWS OF OTHER JURISDICTIONS, INCLUDING YOUR OWN; (2) IRREVOCABLY CONSENTING TO THE EXCLUSIVE JURISDICTION OF, AND VENUE IN, STATE OR FEDERAL COURTS IN THE STATE OF NEW JERSEY OVER ANY DISPUTES OR CLAIMS YOU HAVE WITH US; AND (3) SUBMITTING YOURSELF TO THE PERSONAL JURISDICTION OF COURTS LOCATED IN THE STATE OF NEW JERSEY FOR THE PURPOSE OF RESOLVING ANY SUCH DISPUTES OR CLAIMS. FURTHERMORE, YOU AGREE THAT ANY CAUSE OF ACTION ARISING OUT OF OR RELATED TO THE COMMUNITY MUST COMMENCE WITHIN ONE (1) YEAR AFTER THE CAUSE OF ACTION ACCRUES; OTHERWISE, SUCH CAUSE OF ACTION SHALL BE PERMANENTLY BARRED.

Rules of the Road

The TLE Online Community is open to all points of view on the intended business-related topics, and we are committed to maintaining a comfortable environment for all visitors. Please interact with other users respectfully, as you would in any public or professional arena. If you disagree with the statements of another user, it is acceptable to engage in polite, mature debate. Name-calling, personal attacks, harassment, and other aggressive postings or behavior are not allowed.

All terms in this document are consistent with the terms as defined in the User Agreement.

The following content and conduct are not allowed in the Community and are cause for screen name suspension or termination without explanation or prior notice. Your posts or other communications that include the following content or reflect prohibited conduct, as described below, may be subject to removal. By participating in the Community, you understand and agree not to engage in, encourage, or otherwise support any of the following:

Illegal or fraudulent activity or any harm to the Community or it users

  • You agree not to engage in, promote, or advocate any illegal activity or fraudulent schemes of any kind – including, but not limited to, money laundering, tax evasion, securities fraud, and pyramid or multi-level marketing schemes – through your postings or other use of the Community. You also agree not to post links to other websites that engage in such activities.
  • Do not submit content that you know is false, inaccurate, libelous, or otherwise misleading in any way, and do not mislead us or others regarding the origin of posted content.
  • Do not submit content that contains any computer viruses, worms, or other potentially damaging computer programs or files
  • You must not intentionally impersonate or misrepresent your business or qualifications.
  • Do not post or transmit material you do not have the right to post or transmit under law (such as copyright, trade secret or securities) or due to your personal contractual or fiduciary relationships.
  • Do not post material that violates any applicable law or regulation, including, without limitation, the rules and regulations of the U.S. Securities and Exchange Commission and the national or other securities exchanges, (especially and including the rule against making false or misleading statements to manipulate the price of any security).
  • Do not offer, sell, or buy any security through the Community.
  • Do not offer loans, lines of credit, or other offers of funding through the Community.
  • You may not use the Community in any manner that could damage, disable, overburden, or impair Our servers or networks, or interfere with any other user’s use and enjoyment of the Community.
  • You may not attempt to gain unauthorized access to any services, screen names, computer systems or networks, through hacking, password mining or any other means. We may take any legal and technical remedies necessary to prevent the violation of this provision.

Profane, obscene, inappropriate, disruptive, and unrelated content

  • Indecent, profane, sexually explicit, obscene, or pornographic material of any kind – including masked profanity where symbols, initials, intentional misspellings, or other characters are used to suggest profane language – is strictly prohibited. Businesses or content of an adult sexual nature are not allowed.
  • Threats, personal attacks, abusive, defamatory, derogatory, or inflammatory language, or stalking or harassment of any individual, entity or organization is strictly prohibited.
  • Discriminatory or hateful speech of any kind regarding age, gender, race, religion, nationality, sexual orientation, or disability is strictly prohibited.
  • You agree not to engage in any spamming or excessive posting, or submit content that is disruptive, off-topic, deliberately intended to have a negative impact on the Community or its users, or otherwise interfere with the ability of others to enjoy or comfortably use the Community.

Common Courtesy, Complaints and Etiquette

  • Do not post any personal or identifying information about another person, including addresses, email addresses, contact information, or phone numbers, and use care in posting your personal or identifying information.
  • Remember, your boss, neighbor, friend, family, or co-worker could read your posts.  Make sure you’re not posting anything that would reflect poorly on you or on them, or would bring to light information you intended to remain private.
  • Maintain courtesy and follow good posting etiquette. Posting with ALL CAPS, HTML tags, or excessive typographic symbols may result in your post being removed.
  • The Community should not be used to report a TLE customer service issue. To get help with an issue, please visit our Contact Us.
  • The Community should also not be used to report a customer service issue with any other user’s business. To get help with an issue, please contact that user’s business or your Better Business Bureau. Any posts complaining about another user’s business are subject to removal.
  • Do not engage in disruptive, antisocial or destructive acts, including “flaming,” “flooding,” “spamming,” “griefing” and “trolling,” as those terms are commonly understood.

Solicitations and promotions and other commercial use

  • You agree not to post, or otherwise make available in the Community, any content or third-party website, with the intent of harming the flow of information and/or participation in the TLE Online Community that is competitive with or which otherwise benefits competitors of TLE, including but not limited to promoting competing sites that provide message boards, forums, chats, blogs, etc.
  • Posting unsolicited or unauthorized advertising, promotional materials, junk mail, spam, chain letters, or pyramid or multi-level marketing schemes, or using automated means, including spiders, robots, crawlers, data-mining tools, or other means to download data from the Community is strictly prohibited.

Copyright and intellectual property violations

  • Infringement on any party’s copyright, patent, trademark, trade secret, intellectual property or other proprietary rights, or right of publicity or privacy is strictly prohibited and is the sole responsibility of the user.
  • By submitting any content to the Community, you warrant and represent that you are the copyright owner of the content or that the copyright owner of the content has granted you permission to use such content consistent with the manner and purpose of your use.
  • Using the Community to distribute unauthorized copies of copyrighted material, including photos, artwork, text, recordings, designs, computer programs, or derivative works of such programs is strictly prohibited and subject to removal.
  • We encourage all of our members to associate a personal profile picture and avatar to their accounts. Please note that images associated with your account, including profile images and avatars, will be reviewed by our moderators prior to being visible to others in the community. All images must conform to the terms of the User Agreement and Rules of the Road. Examples of an acceptable profile image could include a picture of you or your business. Please note that many of the images found available on the web are copyrighted material, and will not be approved for posting or sharing in the community. An example would be an image of Mickey Mouse, the Nike logo, or a picture of a celebrity. In general, any images which do not belong to the member cannot be used.

The guidelines are here to: 1) help you become a valuable contributor to the community, 2) explain what kind of conduct to avoid, and 3) make sure the community is enjoyable for – and respectful of – all our users. The goal of the Online Community is to empower our members to build and grow successful businesses. We hope you enjoy visiting the community, return often, and become an active member and frequent contributor.

  1. Keep it clean, keep it professional. Every post should make a positive contribution to the community and should be suitable for all users. The community is open to all points of view on the intended business-related topics; mature, polite debate is encouraged. But we will remove any post or reply that includes derogatory, abusive, offensive, obscene, violent or inappropriate content of any kind.Always interact with other users respectfully, as you would in any professional setting.   2. Stay on topic. Good contributions help the entire community by providing relevant, insightful information or asking important questions. If your post contains anything unrelated to the topic of the forum or article, it may be removed.
  3. Introducing yourself to the community.  If you would simply like to introduce yourself (and your business) to other members, you may do so in our Member Introductions section. Please keep introduction-related posts in this section of the community, otherwise they may be moved or deleted by the community moderators.
  4. Be honest, be yourself. The community is intended to be used for the helpful exchange of information between members. False, inaccurate, or otherwise misleading information is not helpful. Please be sincere in your community participation by only contributing content you know is accurate and not misrepresenting your identity or your business qualifications.
  5. Keep marketing efforts separate; minimize clutter. A post or reply with a personal agenda only benefits the person who writes it, not the community as a whole, and unsolicited advertising adds distracting clutter to the forums. Please respect the community’s mission by not using it as a marketing channel or submitting any content you’ve been paid or otherwise rewarded by a third party to write or post.
  6. Submit only your own, original content. Help us maintain the community’s reputation and observe the intellectual property rights of others by only submitting content you have personally written or else properly attributed. The community should not be used to distribute unauthorized copies of any copyrighted material.

  10. Product or service issues. The Community should not be used to report a customer service issue. To get help with an issue, please visit our Contact Us page. Any posts complaining about an individual customer service issue are subject to removal.
  11. Help look after your community. The community is here for the benefit and enjoyment of members like you. If you notice content within the community that does not abide by the guidelines or User Agreement, please report it to our site moderators by selecting “Report as inappropriate.” Please note that deliberate misuse of the “Report as inappropriate”  feature can result in your account being banned from the community.
